Unbusy LLC (“Unbusy,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you visit getunbusy.io (the “Site”), sign up for our pilot waitlist, communicate with us by phone or text message, or otherwise interact with our services (collectively, the “Services”).

By using our Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use our Services.

We are based in Sioux City, Iowa, and our Services are intended for users located in the United States.

4. SMS Messaging Consent and Data Use

This section is specifically about how we handle information related to text messaging.

4.1 SMS Opt-In — Three Distinct Programs

Unbusy operates more than one SMS communication context. Consent is captured separately for each, and opting in to one program does not constitute opt-in to the others.

Program 1: Pre-pilot lead updates (low frequency, optional). Pre-pilot leads who join the waitlist on getunbusy.io may optionally consent to receive a small number of SMS updates per year about pilot status and launch notifications. This consent is captured via an explicit checkbox on the waitlist form, alongside a clearly displayed consent statement. This consent is OPTIONAL — providing a phone number on the waitlist does not, by itself, opt the lead into this program.

Program 2: Pilot platform messages (for admitted pilot customers only). Once a business owner is admitted to the Unbusy pilot program, that owner may receive operational SMS messages from the Unbusy platform — alerts, notifications, billing reminders, and similar operational communications. Consent for this program is captured separately during pilot onboarding, in the pilot agreement, and is NOT bundled with the waitlist consent above.

Program 3: Business-to-customer messages (the core Unbusy product). End customers of pilot businesses may receive automated SMS from those businesses via the Unbusy platform. Consent for these messages is captured through one of three documented paths (customer-initiated, owner-initiated with affirmative confirmation, or web-form opt-in), as described in our Terms of Service, Section 6.

We retain records of every opt-in (including timestamp, IP address where applicable, the consent text displayed at the time of opt-in, and the originating channel) as required by carrier regulations and applicable consumer protection law.

4.2 Types of SMS Messages

The messages you may receive depend on which program(s) you have opted into:

If you opted in to pre-pilot lead updates (Program 1): You may receive a small number of messages per year (typically fewer than 6) about pilot status, slot availability, and launch notifications.

If you are an admitted pilot customer with platform consent (Program 2): You may receive operational alerts, customer-activity notifications, billing reminders, and other operational messages from the Unbusy platform. Frequency varies based on your customer activity volume.

If you are an end customer of an Unbusy pilot business (Program 3): You may receive appointment confirmations, appointment reminders, customer service responses to your inquiries, booking-related follow-ups, and (separately, if you have opted into marketing) occasional review requests or special offers. Frequency depends on the relationship between you and the business you are interacting with.

Standard message and data rates may apply for all programs. You can opt out at any time by replying STOP, as described below.

4.3 SMS Opt-Out

You can opt out of SMS messages at any time by replying STOP to any message we send you. We will confirm your opt-out and stop sending further SMS messages, except where required for legal or service-completion reasons. Reply HELP for assistance, or contact us at the email below.

4.4 Mobile Phone Numbers and SMS Consent Data — Special Protections

Mobile information, including phone numbers and SMS consent records, will not be shared with third parties or affiliates for marketing or promotional purposes.

All other categories of information described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for any purpose other than the following permitted uses:

5. How We Share Information

Outside of SMS consent data (which has special protections described in Section 4.4), we may share other categories of information in the following limited circumstances:

5.1 Service Providers

We share information with third-party service providers who help us operate the Services. These include Twilio (SMS and telephony infrastructure), hosting and infrastructure providers, and email service providers. Service providers are contractually required to use information only for the purposes we authorize.

5.2 Legal Requirements

We may disclose information if required to do so by law, subpoena, court order, or other legal process, or if we believe in good faith that disclosure is necessary to comply with applicable laws, protect the rights, safety, or property of Unbusy, our users, or the public, or investigate or prevent fraud, security incidents, or other illegal activity.

5.3 Business Transfers

If Unbusy is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of business assets, information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

We may share information for any other purpose with your express consent.

We do not sell personal information to third parties.

6. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. SMS opt-in records are retained as required by carrier regulations. SMS conversation logs (the text of messages sent and received through the Unbusy service) are retained for a period of 24 months from the date of the conversation, after which they are deleted or de-identified. Opt-in consent records are retained for a minimum of 5 years as required by TCPA compliance best practices. When other information is no longer needed, we delete or de-identify it in accordance with our internal retention policies.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no system is perfectly secure. We cannot guarantee absolute security of information transmitted to or stored by us. If we become aware of a security incident that affects your information, we will notify you as required by applicable law.

9. State-Specific and International Privacy Rights

9.1 California Residents (CCPA/CPRA)

9.3 European Economic Area and United Kingdom

If you are located in the European Economic Area (EEA) or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, including the right to access, correct, delete, restrict processing, and port your personal data. Our legal basis for processing is legitimate interests (providing the Services you requested) and consent (where you have provided it for SMS communications).

Note: Unbusy is a U.S.-based service primarily targeting U.S. customers. We do not actively market to or process data of EEA/UK residents. If you are an EEA/UK resident using our Services, please contact us.

10. Children's Privacy

Our Services are not directed to children under 13 (or under 16 in some jurisdictions). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without verified parental consent, we will delete it.

Our Site may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to read their privacy policies before providing any information.

12. International Users

Our Services are intended for users in the United States. If you are accessing our Services from outside the United States, please be aware that information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.
